UK explores AI training on copyrighted material with new proposals
The UK government is exploring new policies that could allow AI companies to use copyrighted material for training without obtaining permission from the rights holders.
A consultation launched on December 17 outlines several proposals for creating legal frameworks to address the intersection of AI and copyright law.
The consultation will remain open for feedback until February 25, 2025.
Peter Kyle, Secretary of State for Science, Innovation, and Technology, highlighted that current uncertainty in copyright law is hindering the growth of both the AI and creative industries.
He stressed the need for a modernised framework to enable both sectors to compete globally.
One proposed policy option would enable AI companies to freely use copyrighted materials without seeking consent from copyright holders, thus permitting commercial use with minimal restrictions.
Another suggestion would allow AI firms to train on copyrighted works unless creators choose to opt out.
The consultation also raises the possibility of introducing stronger copyright laws requiring AI companies to secure licenses for all materials used in training.
However, some believe that maintaining the current system would preserve the uncertainty surrounding the application of copyright in AI training.
Critics, such as Ed Newton-Rex, a British composer and CEO of Fairly Trained, argue that these changes would disproportionately benefit AI firms while harming creators.
Newton-Rex emphasised that a proposed exception to copyright laws would allow AI companies to train on copyrighted works without obtaining licenses, a practice that is currently prohibited.
Owen Meredith, CEO of the News Media Association, criticised the consultation for not addressing enforcement and transparency in protecting creators' rights.
He suggested that the government should prioritise improving transparency within the existing copyright laws rather than introducing new systems.
